Agreement to Terms
By accessing or using the services of MONOGRAM BUILDING & DESIGN, INC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
Services
We provide graphic design and creative services including, but not limited to, brand identity development, logo design, marketing materials, digital design, and creative consulting. The specific scope, deliverables, and pricing for each project will be outlined in a separate project proposal or contract.
Project Process
Proposals: All projects begin with a detailed proposal outlining scope, timeline, deliverables, and pricing. Work will not commence until the proposal is accepted and any required deposit is received.
Revisions: Each project includes a specified number of revision rounds as outlined in the proposal. Additional revisions beyond the included rounds will be billed at our standard hourly rate.
Timeline: We commit to meeting agreed-upon deadlines, provided that client feedback and materials are delivered on time. Delays caused by late client feedback may result in adjusted timelines.
Payment Terms
Deposits: A deposit of 50% of the total project cost is required before work begins, unless otherwise specified in the project proposal.
Final Payment: The remaining balance is due upon project completion, before final files are delivered.
Late Payments: Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month on the outstanding balance.
Accepted Methods: We accept payment via check, credit card, or bank transfer.
Intellectual Property
Client Materials: You retain all rights to materials you provide to us. You represent that you have the right to use any materials provided for the project.
Deliverables: Upon full payment, ownership of the final approved deliverables transfers to you. We retain the right to display the work in our portfolio and for promotional purposes unless otherwise agreed in writing.
Unused Concepts: We retain all rights to unused concepts, sketches, and preliminary work created during the project.
Client Responsibilities
To ensure successful project completion, clients agree to:
- Provide clear project requirements and objectives
- Supply necessary materials, content, and assets in a timely manner
- Provide feedback within agreed-upon timeframes
- Designate a primary point of contact for project communications
- Make payments according to the agreed schedule
Confidentiality
We treat all client information as confidential and will not disclose it to third parties without your consent, except as required by law. We ask that clients also maintain confidentiality regarding our proprietary processes and pricing.
Project Cancellation
If you need to cancel a project, please notify us in writing. Cancellation fees apply as follows:
- Before work begins: Full deposit refund minus 10% administrative fee
- After work begins: Client is responsible for payment of all work completed to date
Limitation of Liability
To the maximum extent permitted by law, MONOGRAM BUILDING & DESIGN, INC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific project in question.
Indemnification
You agree to indemnify and hold harmless MONOGRAM BUILDING & DESIGN, INC from any claims, damages, or expenses arising from your use of materials you provided, your use of the deliverables, or your breach of these terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Worcester County, Maryland.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
